General Purchase Contract Thank your for purchasing one of our Drool Gang puppies. We strive to produce pups that will be comfortable in a home setting or in the show ring. We put allot of work into our dogs and subsequently their offspring, we also work hard in finding that perfect home, where the puppies will spend their life being treated with respect and given only the best care and attention. This contract is the culmination of 3 years worth of contracts and we are sure it will be changed again, to better suit the sellers, buyers and specially the puppies needs. We do not want you to feel this contract is restrictive, but simply a way of agreeing on what is best for all involved. Please read this contract carefully, we will not bend the rules so to speak, so please be sure this is something you want to become involved with and agree to. Companion Only Contract Pups/Dogs that have been sold on a Companion Only basis will not be used for breeding purposes. You will receive AKC-FSS paperwork on the pup/dog, but it will be limited. Limited meaning any offspring resulting from the animal will not be registered through the AKC or any other registry. You will not receive the original copy until we have received a confirmation letter from your vet stating the Pup/Dog has been spayed/neutered. Seller may also at their discretion alter the pup/dog before they are shipped/delivered to buyer. For more information please read your Companion Only contract carefully. Check here if dog/pup is being sold as companion only ( ) Seller Signature Date Buyer Signature Date Show/Breed Pup/Dog Seller does not guarantee that described pup/dog will be show/breed quality on maturity. Seller does state that said pup/dog does not have any evident disqualifying features and shows good breed type at time of sale. All efforts will be made through photos to show accurate breed type. Health Guarantee Seller states at time of sale or shipment (whichever is closest to the pup/dog leaving sellers care) that it is healthy and free of any disease nor afflicted with any illness. You the seller have 72 hours to take your pup/dog to a licensed veterinarian to have a complete health check of the pup/dog. If at that time there is a problem found then buyer is to contact seller at once. We do not guarantee against cherry eye. There is no way of preventing this in the breed and we cannot guarantee against the pup/dog acquiring it. If at any time a problem is found with your dog that is genetically related Buyer is to contact seller immediately. Take Back Policy Seller agrees to take back pup/dog at anytime during its lifetime. If at anytime the buyer can no longer care for or properly keep pup/dog they are to contact seller at once. Buyer is responsible for any expenses incurred for shipment of pup/dog back to seller. Buyer is responsible for any expenses incurred by seller for travel cost to retrieve pup/dog. Seller also has the option of finding other appropriate housing for pup/dog and that buyer will relinquish pup/dog to new home. If at anytime buyer needs to place the pup/dog in a new home then they are to contact seller for help in doing so. At no time shall pup/dog be placed into a shelter or rescue organization, to do so places buyer into breach of contract. At no time shall pup/dog be abandoned or given away to a third party without notifying seller before hand. We are here to help you in case you cannot keep pup/dog, please contact us if you need any assistance in this matter at anytime. General Conditions Buyer agrees that the pup/dog will not be used for any illegal purposes including dog fighting. Pup/dog is not to be purchased to be used in any crossbreeding purposes; this includes any breeding of Bandogs. Pup/dog is not to be purchased for use in or to provide offspring to puppy mills, puppy brokers or pet stores. If at anytime pup/dog is used for any of these purposes and the name and kennel name of seller is slandered then buyer is in breach of contract and proper action will be taken. Please refer to breach of contract. Buyer agrees to care for the pup/dog in according with the following guidelines. Top quality food must be provided for the pup/dog throughout its lifetime. Fresh clean water shall be provided for pup/dog at all times. Appropriate housing and fencing will be proved to pup/dog. The pup/dog will be part of the family and not just left on its own. It will never be left alone for long periods of time, nor confined in an outdoor enclosure away from the family for extended periods of time. Pup/dog will be treated with dignity and shall suffer no abuse of any kind, mentally or physically at the hands of buyer. Pup/dog will begin obedience lessons at the age of 12 weeks and continue until properly trained and periodically from then on. Pup/dog will be socialized and never be allowed to act out any aggressive behavior. Pup/dog shall not be taught any aggressive behavior nor encouraged to act out any behavior of this type. After reviewing this buyer agrees to these conditions. Kennel Name Prefix Any pup/dog bred by seller will carry the prefix of Drool Gang on their paperwork. Example: you want to register your pup’s name as fido, you would first add Drool Gang's into the kennel prefix, thus making the official registered name being Drool Gang's Fido. We work very hard to produce excellent pups/dogs and would like to see our kennel name on their papers. It is so much easier to identify who bred them with the kennel name prefix and we are proud to see our name on their papers. There will be no exceptions to this stipulation, you may name your pup anything you want but our kennel name goes on identifying us as breeder. Breach of Contract This comes into affect when either party refuses declines or deliberate breaks any of the terms set forth in this contract. If any condition or term is broken by buyer then seller will not delay in taking the appropriate steps to rectify the situation. In the event a breach of contract occurs and court proceedings must be taken then they will be held in Sellers State of residence. If however seller is made to travel to Buyers State of residence then buyer is responsible for all of sellers expenses not limited to court costs, travel expenses and lost wages. All efforts will be made by seller to prosecute to the fullest extent of the law. Buyer shall also pay any expenses incurred when seller has to travel to claim a dog back because of breach of contract. In the event that pup/dog is injured or killed due to a breach of contract condition then the sum of the value of the pup/dog plus any other expenses is due to seller. In the event that sellers name is defamed or slandered stemming from buyers breach of contract then seller will pursue legal action and ask for liquidated damages and any expenses incurred not limited to travel costs, court fees and lost wages. USNMC Sponsorship Seller is a member in good standing of the USNMC (United States Neapolitan Mastiff Club) we abide by all the rules and bylaws they set forth. Being a member of this club allows us to sponsor in new members. We would like to extend to the seller the option of joining in the club if they so desire. The seller agrees to sponsor the buyer in to the USNMC if after 6 months from date of purchase, buyer has provided and cared for pup/dog exceptionally and has not entered into a breach of contract. Buyer should prove to seller that they have the best interests of their pup/dog and for the breed overall and wish to become club members. There is a fee of 30.00 payable to the USNMC that is the buyer’s responsibility. To become a full member you must send in the application with sellers signature certifying they are sponsoring you and the fee. Please contact seller for more info on this. Sellers Rights of Limitations Seller will not be reasonable for any dog bite; attack or mauling resulting from sold pup/dog. Any and all liabilities stemming from this are the sole responsibility of buyer and no charges or judgments will be made against seller. By signing all parties involved with the sale and purchase of pup/dog have agreed they have read agree to and understand the terms and conditions of this contract. If there are any question from either party they need to be addressed before the signing of the contract. This contract becomes legally binding once all signatures required have been signed to this contract.
